"Roughly half of all women who married in early America became widows in their lifetimes, usually in their late 40s, and sometimes (with remarriage) more than once. A
widow at common law however had no right of inheritance of her husbands’ estate and only a limited right even to live on the land she had helped clear and farm. She had no right to the guardianship of her children’s property and often lost physical custody of the children if her own means weren’t enough to support the family. Children fared better in some ways under the law. Whatever wasn’t guaranteed to the widow by law always went to any children."
